What constitutes a claim?
A claim is any demand for compensation by a patient or an attorney representing a patient, which arose from the rendering or failure to render professional services. There are three ways you may be notified of a claim. First, a summons and complaint may be filed in either state or federal court. If you receive a summons and complaint, you should immediately contact the Claim Department.* The summons and complaint is normally served in person by a process server or deputy sheriff. It may also be mailed to you or left at your office or home. Both state and federal courts require a formal answer be filed on your behalf within a specified limited time period from the date you are served with the summons and complaint. If an answer is not filed within that amount of time, the attorney representing the plaintiff can file a motion for a default judgment. If the default judgment is granted by the court, you may be automatically found responsible for the damages claimed by the plaintiff without being heard.
You might receive a letter directly from the patient or an attorney representing the patient containing allegations of negligence or wrongdoing, a description of the injury or damage suffered and some type of demand for compensation. The letter may also indicate that a claim for malpractice is being pursued against you and request that you notify your professional liability carrier. You should immediately contact the Claim Department.
Finally, occasionally a patient may make a verbal claim for compensation. It is our recommendation that you ask the patient to put his or her demand in writing and submit it to you for review. You should then forward the written complaint/demand to the company so that we can begin our investigation.

How and when does one report a claim?
If you receive a summons and complaint, it is extremely important that you contact the Claim Department* as soon as possible. You can either call the company to report the suit, contact your agent, or mail or fax the complaint with a cover that includes your name and policy number. If you call, it is important to promptly send the company a written notification. A file will be set up and you will be assigned to a claim representative who will handle the file, assign defense counsel, and meet with you to discuss the suit.

You can fax the claim letter and your cover letter to 617.428.9805. Your cover letter should include your policy number and basic information about the loss.
